Terms of Service

Effective September 22, 2026

These Terms of Service ("Terms") govern your access to and use of TORQ Track, including our website, web application, and related services (together, the "Service"), operated byMario Todorovski, an individual sole trader based in North Macedonia ("TORQ Track," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and ourRefund Policy. If you do not agree to these Terms, do not use the Service.

1. Who can use TORQ Track

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a TORQ Track account or purchase a paid plan. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate and kept up to date.

2. Your account

You are responsible for maintaining the security of your account credentials and for activity that occurs under your account. If you suspect unauthorized access, contact us promptly atinfo@torqtrack.app.

We may suspend or terminate an account that violates these Terms or where we reasonably believe suspension is necessary to protect TORQ Track, our users, or the Service, subject to applicable law.

3. What TORQ Track is - and isn't

TORQ Track helps you record and understand vehicle-related information, including mileage, fuel and charging, maintenance, expenses, and, with TORQ Track Driver, rideshare and delivery earnings.

Figures displayed by TORQ Track - including cost-per-mile calculations, maintenance reminders, business-use calculations, and profit calculations - are estimates based on information you provide. The Service is provided for informational purposes only and doesnot constitute tax, financial, accounting, legal, or automotive-safety advice.

You are responsible for reviewing and verifying information before relying on it for tax filings, expense reports, financial decisions, vehicle decisions, or other important purposes.

TORQ Track may provide tools that estimate potential tax deductions or business-use percentages using information you enter, including odometer readings, logged shifts, and expense entries. We do not independently verify this information. TORQ Track is not a tax preparer and does not file tax returns on your behalf. Use of our tax-related tools does not create a tax preparer-client, accountant- client, or other professional relationship. Tax laws vary by jurisdiction and may change over time. You are responsible for confirming important tax information with a qualified tax professional or applicable tax authority before relying on it for a filing.

4. Free plan and free trial

TORQ Track offers a Free plan with core tracking features. When you create an account, you may also receive a 30-day free trial providing access to the features ofTORQ Track Driver, our highest plan.

  • No payment details are required to start the free trial.
  • The trial does not automatically convert into a paid subscription.
  • You are charged only if you actively choose a paid plan and complete the checkout process.
  • When the trial ends, your account automatically returns to the Free plan.
  • Your data remains in your account, but paid-plan features and limits no longer apply unless you subscribe.
  • The free trial is limited to one trial per person. Creating additional accounts to obtain additional trials is not permitted.

We may refuse, restrict, or terminate a trial where we reasonably believe that the trial terms are being abused.

5. Paid plans, pricing, subscriptions, and billing

TORQ Track offers paid plans including TORQ Track Proand TORQ Track Driver. Paid plans are available as recurring monthly or yearly subscriptions at the prices displayed at checkout.

Prices are displayed in USD unless otherwise stated at checkout. Applicable taxes may be added or included as determined by Paddle and applicable law.

Paddle as Merchant of Record

Paddle.com Market Limited ("Paddle") acts as our authorised reseller and Merchant of Record for purchases made through Paddle.Our order process is conducted by our online reseller Paddle.com.Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

When you purchase a TORQ Track subscription through Paddle, you purchase the product from Paddle, while TORQ Track provides and supports the Service. Paddle processes the payment, handles applicable taxes and invoicing, and issues the transaction receipt. We do not receive or store your full payment-card number.

Your purchase is also subject to the applicablePaddle Buyer Termsand Paddle's applicable refund terms.

Automatic renewal

Paid subscriptions automatically renew at the end of each billing period unless cancelled before the next renewal. The applicable price and billing interval are shown during checkout.

Cancellation

You may cancel your subscription at any time through the subscription- management options available through your TORQ Track account or Paddle's subscription-management tools. Cancellation stops future renewals. Unless you are entitled to a refund under our Refund Policy, Paddle's policies, or applicable law, cancellation does not automatically refund the current billing period. Your paid features normally remain available until the end of the period that has already been paid for.

6. Changing plans

Where the Service allows it, you may switch between TORQ Track Pro and TORQ Track Driver or between monthly and yearly billing. A plan change may take effect immediately. Where applicable, the remaining portion of your current billing period may be calculated on a prorated basis, with the resulting amount charged or credited.

If a payment required for a plan change fails, the requested change may not be applied and your existing plan may remain active. You cannot change plans while a cancellation is scheduled unless you first resume the subscription.

7. One-time purchases

Some products may be sold separately from subscriptions. Currently, this includes the Sell My Car PDF, a digital report generated for one vehicle in your account at the price displayed at checkout.

  • It is a digital product generated from information you provide.
  • It is made available after purchase.
  • It is purchased separately for each vehicle.
  • It is not a vehicle valuation or professional appraisal.

Because it is generated from your data, the report may contain estimates or inaccuracies resulting from incorrect or incomplete information entered by you. Refunds are governed by ourRefund Policy and applicable consumer law.

8. Acceptable use

You agree not to:

  • use the Service for an unlawful purpose;
  • infringe another person's rights;
  • attempt to access another user's account or data without authorization;
  • reverse-engineer, scrape, interfere with, or disrupt the Service or its underlying infrastructure;
  • create multiple accounts to obtain additional free trials;
  • introduce malicious code or otherwise interfere with the security or operation of the Service; or
  • knowingly enter false vehicle, earnings, or expense information with the intention of defrauding a third party, including an employer, insurer, purchaser, or tax authority.

9. Your data and content

You retain ownership of the vehicle, trip, expense, earnings, and other information that you enter into TORQ Track. You grant us a limited license to host, process, store, display, and otherwise use that information as reasonably necessary to provide, maintain, secure, and improve the Service, subject to our Privacy Policy.

You may export your data using the export functionality made available by TORQ Track. Account and data deletion is handled as described in our Privacy Policy.

10. Third-party services and integrations

TORQ Track does not currently provide integrations with third-party vehicle-history providers, rideshare platforms, or delivery platforms. Information relating to services such as Uber, Lyft, or DoorDash is entered manually by you unless we expressly state otherwise.

If we introduce third-party integrations in the future, we may update these Terms and our Privacy Policy to explain how those integrations operate. Third-party services may have their own terms, privacy policies, availability, and accuracy limitations.

11. Intellectual property

TORQ Track, including its name, logo, software, website, interface, design, features, and underlying code, is owned by or licensed to Mario Todorovski and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of TORQ Track or its intellectual property to you.

We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose while your account is active and your subscription, where applicable, remains valid.

12. Service availability and disclaimers

The Service is provided "as is" and "as available" to the maximum extent permitted by applicable law. We do not guarantee that the Service will always be available, operate without interruption, be error-free, be compatible with every device or browser, or produce completely accurate calculations or estimates.

In particular, we do not guarantee the accuracy of mileage, cost, maintenance, earnings, profit, tax, or other calculations generated from information entered by users.

Nothing in these Terms excludes or limits any consumer rights or other rights that cannot lawfully be excluded or limited.

13. Limitation of liability

To the maximum extent permitted by applicable law, TORQ Track and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business opportunities, or data arising from or related to your use of the Service.

To the maximum extent permitted by applicable law, our total liability for claims arising from or relating to the Service will not exceed the amount you paid to us or through Paddle for the Service during the12 months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14. Suspension and termination

You may stop using TORQ Track at any time. You may request deletion of your account as described in our Privacy Policy.

Deleting your account does not automatically cancel a paid subscription. You should cancel the subscription separately before deleting your account if you do not want future renewal charges.

We may suspend or terminate access to the Service if you materially breach these Terms, subject to applicable law. Where practical, we will provide notice and an opportunity to remedy a breach before suspension or termination.

Termination does not affect rights or obligations that arose before termination.

15. Changes to the Service

We may modify, add, remove, or discontinue features of the Service from time to time. Where a change materially reduces the functionality of a paid Service, we will provide notice where reasonably practicable and comply with any rights you may have under applicable law.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or through an in-app notice, before the changes take effect where required by law.

The updated Terms will apply from their effective date. If you continue using the Service after the updated Terms take effect, your continued use constitutes acceptance of the updated Terms to the extent permitted by applicable law.

17. Governing law and consumer rights

These Terms are governed by the laws of North Macedonia, without regard to conflict-of-law principles. Any disputes will be subject to the courts of Skopje, North Macedonia, except to the extent that applicable mandatory consumer-protection law gives you rights to bring proceedings elsewhere or requires the application of another jurisdiction's law.

Nothing in these Terms limits mandatory consumer rights applicable in your country of residence.

18. Entire agreement and severability

These Terms, together with the Privacy Policy and Refund Policy, form the agreement governing your use of TORQ Track, except where additional terms are expressly presented to you for a particular product or transaction.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. Our failure to enforce a provision immediately does not waive our right to enforce it later.

Privacy Policy

Effective September 22, 2026

This Privacy Policy explains what information TORQ Track collects, how we use it, and the choices you have. It applies to the TORQ Track website and web application (together, the "Service"), operated by Mario Todorovski, an individual sole trader based in North Macedonia, who is the controller of your personal data for the purposes of this Policy.

1. Information we collect

We collect information in three ways:

  • Information you provide directly - account details (email and password, or your email and name if you sign in with Google), vehicle details (make, model, year, drivetrain), and the data you log: mileage, fuel and charging, maintenance records, expenses, insurance, and - on TORQ Track Driver - rideshare and delivery earnings. If you send us feedback or contact support, we keep that message.
  • Information collected automatically - standard technical data (IP address, browser type, device information) collected by our hosting infrastructure as part of normal web traffic, and the information needed to keep you signed in. We also use Google Analytics to understand how the Service is used (pages viewed, approximate location, device type, and similar usage patterns) - see "Cookies and local storage" below for how this is gated by your cookie choice. We don't use advertising trackers or cookies.
  • Trip and mileage data - the trips, mileage, and timing you log yourself (for example, odometer readings or logged shifts), so we can calculate cost-per-mile and other figures. TORQ Track does not currently track your location or GPS route automatically - everything is entered by you.

Payments. When you buy something, you enter your payment details directly with Paddle, not with us. Paddle tells us the result of the purchase and basic subscription information (for example, your plan, billing cycle, subscription status and renewal date), but we don't receive or store your full card number.

Notifications. If you turn on push notifications, your browser gives us a notification address for your device so we can send maintenance reminders and trial or billing alerts. You can turn these off in your browser or device settings at any time.

2. How we use your information

  • To provide the Service - tracking, cost calculations, maintenance reminders, and earnings tools;
  • To start and manage your free trial and subscription, process purchases, and manage your account;
  • To send service-related communications, like maintenance alerts, trial-ending notices, or billing receipts;
  • To send product updates or marketing emails, which you can opt out of at any time;
  • To detect, prevent, and address fraud, abuse (including repeated free-trial abuse), or security issues;
  • To improve TORQ Track's features based on aggregated, de-identified usage patterns.

We don't sell your personal information, and we don't share your individual trip, expense, or earnings data with advertisers.

If you're in the EEA or UK, our legal bases for this processing are: performing our contract with you (providing the Service and your plan), our legitimate interests (security, fraud prevention, and improving the Service), legal obligations (such as record-keeping), and your consent where we ask for it (such as push notifications or marketing).

3. How we share information

We share information only where necessary. Our main service providers are:

  • Paddle - our payment processor and Merchant of Record. Paddle handles your checkout, payment details, taxes and invoices, and acts as an independent controller of the data it needs for those purposes. Paddle's checkout may also load its own tools (for example, for subscription billing and fraud prevention) underPaddle's privacy notice;
  • Supabase - provides our database, sign-in, and backend functions, where your account and the data you log are stored;
  • Vercel - hosts the website and web application;
  • Resend - delivers emails we send, such as responses to feedback;
  • Google (Sign-In) - only if you choose to sign in with Google, in which case Google shares your basic profile details (such as your email and name) with us.
  • Google (Analytics) - if you accept analytics cookies, Google Analytics processes usage data on our behalf to help us understand how the Service is used. This only runs after you consent - see "Cookies and local storage" below.

These providers process data on our behalf and are limited to providing their service. We also share information in these cases:

  • Integrations you connect - TORQ Track doesn't currently offer third-party account connections (for example, to vehicle history providers or rideshare/delivery platforms). If we add these in the future, any data you authorize will be shared with that service per your instructions, and we'll update this Policy first.
  • Legal and safety reasons - if required by law, legal process, or to protect the rights, property, or safety of TORQ Track, our users, or the public;
  • Business transfers - if TORQ Track is involved in a merger, acquisition, or asset sale, your information may be transferred as part of that transaction, subject to this Policy.

4. Cookies and local storage

Essential. We use browser storage to keep you signed in and remember your preferences, and a service worker so the app can work like an installed app and receive notifications. This runs regardless of your cookie choice, since it's needed for the Service to work.

Analytics. We use Google Analytics cookies to understand how our website is used. These are off by default - nothing is set until you click "Accept" on the cookie banner. If you click "Reject," or don't make a choice, analytics cookies stay off. You can change your choice at any time using the "Cookie settings" link in the footer. We don't use advertising or remarketing cookies, and Google Analytics doesn't set any of those either.

Payments. When you open checkout, Paddle may set its own cookies or storage as described in its privacy notice.

5. Data retention

We keep your account and vehicle data for as long as your account is active, so your history stays available to you. If you delete your account, we delete or anonymize your personal data within90 days, except where we're required to keep certain records longer (for example, billing records for tax purposes, which Paddle also holds as Merchant of Record).

6. Your choices and rights

  • Access and export - export your vehicle and trip data at any time from your account.
  • Correction - update your account and vehicle details directly in the app.
  • Deletion - request deletion of your account and associated data by emailinginfo@torqtrack.app from the address on your account. We'll reply within 30 days and process the request manually; a self-serve deletion option in the app isn't available yet. Cancel any paid subscription first (Plans tab in your profile) so you aren't billed again.
  • Marketing opt-out - unsubscribe from marketing emails using the link in any message; you'll still receive essential service and billing notices.

If you're in the EEA, UK, or a US state with its own privacy law (such as California), you may have additional rights under GDPR, UK GDPR, or state privacy laws, including the right to object to or restrict certain processing, and to complain to your local data protection authority. Email us to exercise these rights.

7. Data security

We use industry-standard safeguards - including encryption in transit - to protect your information. No method of transmission or storage is perfectly secure, so we can't guarantee absolute security, but we work to keep your data protected and to respond quickly if something goes wrong.

8. Children's privacy

TORQ Track is not directed to children under 16, and we don't knowingly collect personal information from them. If you believe a child has provided us with personal information, contact us and we'll delete it.

9. International users and data transfers

TORQ Track is operated from North Macedonia, and our database is hosted with Supabase in theUnited States. If you accept analytics cookies, Google also processes that data in the United States. If you use the Service from another country, your information will be transferred to and processed in the United States and North Macedonia, which may have different data protection laws than your own. Where required, we rely on appropriate safeguards for these transfers, such as the standard contractual clauses our providers offer.

10. Changes to this Policy

We may update this Privacy Policy from time to time. If we make material changes, we'll notify you by email or an in-app notice before they take effect.

Refund Policy

This Refund Policy explains the refund rules applicable to purchases of TORQ Track subscriptions and one-time digital products.

TORQ Track is operated by Mario Todorovski, an individual sole trader based in North Macedonia. Purchases made through Paddle are processed by Paddle.com Market Limited, which acts as our authorised reseller and Merchant of Record.

Paddle handles payment processing, applicable taxes, transaction records, and the mechanics of issuing refunds. Paddle's ownBuyer Termsand applicable refund terms also apply.

Nothing in this Refund Policy limits any mandatory consumer rights that apply to you under the laws of your country.

1. Free plan and free trial

The TORQ Track Free plan does not require payment. The 30-day free trial also does not require payment details and does not automatically convert into a paid subscription. Because no payment is taken for the Free plan or free trial, there is no payment to refund. Your first paid charge occurs only when you actively choose a paid plan and complete the checkout process.

2. 14-day money-back guarantee

When you subscribe to a paid TORQ Track plan for thefirst time, you may request a full refund within14 days of your first payment, without needing to provide a reason.

This commercial money-back guarantee applies to the first subscription payment only. It does not automatically apply to renewal payments, a later resubscription after you have previously had a paid subscription, or charges for separate one-time products, except where otherwise stated in this Refund Policy or required by applicable law.

This commercial guarantee is in addition to and does not limit any mandatory consumer rights you may have under applicable law.

3. Renewal charges

Paid subscriptions renew automatically unless cancelled before the next renewal. Renewal charges are generally non-refundable under this Refund Policy because the subscription provides continued access to paid features during the applicable billing period.

However, refunds may be available where:

  • you qualify under applicable consumer law;
  • the charge was made in error;
  • you were charged more than once for the same billing period;
  • a billing problem prevented you from receiving the paid Service; or
  • another refund right applies under this Policy or Paddle's policies.

Cancelling a subscription prevents future renewal charges but does not, by itself, refund a period that has already been paid for.

4. Annual subscriptions

Annual plans are billed once per year at the applicable annual price displayed at checkout. The 14-day money-back guarantee described in section 2 applies to the first payment for an annual subscription.

Outside that guarantee period, annual subscription payments are generally non-refundable except where required by applicable law or where another exception in this Refund Policy applies. You may cancel an annual subscription at any time to prevent it from renewing for another year.

5. Plan changes

If you change between plans or billing cycles, the applicable price difference may be calculated on a prorated basis. Where a prorated charge is made, it is treated as part of the applicable subscription.

If the 14-day first-payment guarantee still applies to you, the applicable refund may include the relevant prorated amount. Otherwise, prorated charges are generally non-refundable except where required by applicable law or another exception in this Policy applies.

6. Sell My Car PDF

The Sell My Car PDF is a digital product generated from information in your TORQ Track account and made available after payment.

Because the product is generated and delivered digitally, it is generally non-refundable once delivered, except where:

  • the file is defective and we cannot reasonably fix it;
  • the file cannot be opened and we cannot reasonably provide a usable replacement;
  • payment was taken but the file was not delivered;
  • you were charged more than once for the same vehicle/report;
  • you are entitled to a refund under applicable consumer law; or
  • another refund right expressly applies under this Policy.

Where applicable law gives you a statutory withdrawal right for a digital product, that right may be affected when you expressly request or consent to immediate performance or delivery of the digital product. Nothing in this section limits rights that cannot legally be waived.

7. Other refund exceptions

Regardless of the timing or product involved, we will provide an appropriate refund where required by applicable law.

We may also provide a refund where:

  • you were charged in error;
  • you were charged more than once for the same transaction or billing period;
  • a technical or billing problem on our side prevented you from accessing a paid Service;
  • the purchased product was not delivered;
  • the purchased product was materially defective and we cannot reasonably remedy the issue; or
  • Paddle determines that a refund is appropriate under its applicable policies.

8. Refunds and Paddle

Because Paddle is the Merchant of Record and authorised reseller for purchases made through Paddle, refunds for those purchases are processed through Paddle rather than paid directly by TORQ Track.

If we agree that you are entitled to a refund, we will instruct or work with Paddle to process the refund. Paddle generally returns refunds to the original payment method, subject to its policies and the payment provider's processing times.

Once a refund is issued, your access to the refunded product or subscription may be ended in accordance with Paddle's policies and the circumstances of the refund.

9. How to request a refund

You may request a refund by emailinginfo@torqtrack.app. Please include the email address associated with your TORQ Track account, the email address used for the purchase if different, your Paddle order or receipt information if available, the product or subscription involved, and a short explanation of your request.

You may also contact Paddle directly throughPaddle.comusing the receipt or order information associated with your purchase.

10. Refund processing

Where a refund is approved, it will normally be returned to the original payment method through Paddle. The time required for the refund to appear in your account may depend on your bank, card issuer, or payment provider. We do not control the processing time after Paddle has initiated the refund.

11. Fraud and abuse

Refunds may be refused where there is evidence of fraud, deliberate abuse of refund rights, repeated abusive refund requests, or other manipulative behaviour, subject to applicable law. This does not limit any mandatory consumer rights.

12. Consumer rights

Nothing in this Refund Policy limits or excludes any consumer rights that cannot lawfully be limited or excluded. If the law of your country provides a mandatory right to cancel, withdraw, obtain a refund, or receive a remedy, that right continues to apply regardless of this Policy.
